Terms of Use – ListOwner License Agreement
TITLE
Title, ownership rights, and intellectual property rights in the service (“Service”) and documentation (“Documentation”) shall remain in the BlessedMail.com eMail Service and/or its suppliers. The Service is protected by copyright laws and treaties.
DEFINITIONS
For the purposes of this License Agreement, the following terms shall have the following meanings:
ListOwner: The person or company using the Service to send messages to Subscribers.
Subscriber: The person using the Service to receive messages from List Owners.
Mailing List: A collection of Subscribers, each of whom has assented to receive messages from a ListOwner.
GRANT
The BlessedMail.com eMail Service grants to you a non-exclusive license to use the accompanying Service and Documentation. As a user of this free service you may:
1. Create and manage one or more Mailing Lists.
2. Send messages to Subscribers.
3. Receive BlessedMail.com eMail Service newsletters.
As the licensee of a BlessedMail.com eMail Service License you may not:
Modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Service or parts of the Service.
Rent, lease, grant a security interest in, or otherwise transfer rights to the Service.
Remove any proprietary notices or labels on the Service.
Use the Service to promote sites containing adult-oriented material, sites encouraging illegal activity or racism, or other sites the administrators deem to be inappropriate.
ListOwner must provide all equipment necessary to establish a connection to the World Wide Web and pay any telephone service fees associated with such access.
ACCEPTANCE OF TERMS OF SERVICE
BY COMPLETING THE REGISTRATION PROCESS, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE BLESSEDMAIL.COM EMAIL SERVICE.
UPGRADES
The BlessedMail.com eMail Service reserves the right to update and upgrade the service including but not limited to user interface, demographic questions, procedures and documentation.
EMAIL ADDRESSES
The BlessedMail.com eMail Service agrees not to sell or rent the email addresses of any ListOwner or Subscriber to any third party.
ADVERTISEMENTS
The BlessedMail.com eMail Service reserves the right to include in each message sent through the Service one or more advertisements for a third party advertiser. All revenues received for such advertisements will be retained solely by the BlessedMail.com eMail Service. Advertisements may appear before and/or after the ListOwner’s message and will be formatted in a manner similar to the following:

Third-Party Advertisement. Advertisements will be brief
and may include a link to a third-party web site.

NOTICE
The BlessedMail.com eMail Service reserves the right to include in each message sent by the Service a notice similar to the following:
“Stay in touch! Use the FREE BlessedMail.com eMail Service for all of your group emailing needs!
http://www.BlessedMail.com”
TERM AND TERMINATION
This license will terminate automatically if you fail to comply with the limitations described herein. The BlessedMail.com eMail Service has the right to terminate the license of any BlessedMail.com eMail Service ListOwner or Subscriber at any time.
LIMITED WARRANTY
The BlessedMail.com eMail Service does not warrant that your use of the Service will be uninterrupted, messages will be delivered, or that the operation of the Service will be error-free or secure.
The BlessedMail.com eMail Service is not responsible for Licensee’s data residing on The BlessedMail.com eMail Service servers.
Licensee is responsible for all use of Licensee’s account and confidentiality of Licensee’s password and information.
LICENSEE EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT LICENSEE’S SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
THE BLESSEDMAIL.COM eMail Service MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES The BLESSEDMAIL.COM eMail Service MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS THAT VARY BY JURISDICTION.
Miscellaneous
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. If any of the terms, provisions, covenants or conditions of this Agreement are held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. This Agreement constitutes the sole and only agreement of the parties hereto and correctly sets forth the rights, duties, and obligations of each to the other.
